These Terms of Service (“Terms”) govern your use of the RSustain Academy online learning platform at academy.rsustain.co.uk, operated by Resilient Sustainance Limited (“RSustain”, “we”, “us”, or “our”).

By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, you must not use the platform.

1. Acceptance of Terms

By creating an account, enrolling in a course, or otherwise using RSustain Academy, you confirm that:

You are at least 18 years of age, or have the consent of a parent or guardian.
You have read, understood, and agree to be bound by these Terms and our Privacy Policy.
The information you provide during registration is accurate and complete.

2. Account Registration

You must create an account to enrol in courses. You are responsible for maintaining the confidentiality of your login credentials.
You must provide accurate and current information during registration and keep your account details up to date.
You are responsible for all activity that occurs under your account. Notify us immediately at learn@rsustain.co.uk if you suspect unauthorised access.
We reserve the right to suspend or terminate accounts that violate these Terms or remain inactive for an extended period.

3. Course Access and Enrolment

Upon successful enrolment and payment, you will be granted access to the relevant course materials for the duration specified in the course description.
Course access is personal and non-transferable. You may not share your account or course access with others.
We reserve the right to update, modify, or discontinue course content at any time to ensure accuracy and relevance. Where material changes affect an active enrolment, we will notify you in advance.
Certificates of completion are issued at our discretion upon satisfactory completion of course requirements as outlined in each course.

4. Payment Terms

Course fees are displayed on the platform at the time of enrolment and are inclusive of applicable taxes unless stated otherwise.
Payments are processed securely through Stripe and/or Razorpay. By making a payment, you also agree to the relevant payment processor’s terms of service.
All prices are quoted in the currency displayed at checkout.

Refund Policy

You may request a full refund within 14 days of purchase, provided you have not accessed more than 20% of the course content.
Refund requests should be sent to learn@rsustain.co.uk with your order reference.
Refunds will be processed to the original payment method within 10 business days.
We reserve the right to decline refund requests that do not meet the above criteria or where we reasonably suspect abuse of the refund policy.

5. Intellectual Property

All course content, materials, logos, trademarks, and platform design are the intellectual property of Resilient Sustainance Limited or its licensors and are protected by applicable copyright and intellectual property laws.
Your enrolment grants you a limited, personal, non-exclusive, non-transferable licence to access and view course materials for your own educational purposes only.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any course content without our prior written permission.
Screen recording, downloading (except where expressly permitted), or sharing of course materials is strictly prohibited.

6. User Conduct

When using our platform, you agree not to:

Use the platform for any unlawful purpose or in violation of any applicable laws or regulations.
Share, distribute, or resell course content or your account credentials.
Attempt to gain unauthorised access to any part of the platform, other user accounts, or our systems.
Upload or transmit viruses, malware, or any harmful code.
Engage in conduct that is abusive, harassing, or disruptive to other users or our staff.
Use automated tools (bots, scrapers, etc.) to access or interact with the platform without our written permission.

We reserve the right to suspend or terminate your account without refund if you breach any of these conduct requirements.

7. Disclaimer of Warranties

The platform and course content are provided on an “as is” and “as available” basis. While we endeavour to ensure accuracy and quality, we make no warranties or representations, express or implied, regarding:

The completeness, accuracy, or reliability of course content.
Uninterrupted or error-free access to the platform.
The suitability of courses for any particular purpose or professional qualification, except where explicitly stated.

8. Limitation of Liability

To the maximum extent permitted by law:

Resilient Sustainance Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
Our total liability for any claim arising from these Terms or your use of the platform shall not exceed the total fees you have paid to us in the 12 months preceding the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

9. Indemnification

You agree to indemnify and hold harmless Resilient Sustainance Limited, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your use of the platform.

10. Third-Party Links

Our platform may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party sites. Access to such sites is at your own risk.

11. Modifications to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the platform. Your continued use of the platform after changes take effect constitutes acceptance of the revised Terms.

12. Termination

You may close your account at any time by contacting us at learn@rsustain.co.uk.
We may suspend or terminate your access to the platform at any time for breach of these Terms, with or without notice.
Upon termination, your right to access course materials will cease immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) shall continue to apply.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
